Rehearing denied January 29, 1981. The defendant, Charles Kuesis, was charged with burglary (Ill. Rev. Stat. 1977, ch. 38, par. 19-1). He was found guilty after a bench trial in the circuit court of Cook County. At the conclusion of a sentencing hearing, the court imposed a sentence of 2 1/2 to 7 1/2 years in the penitentiary. The defendant appealed. The appellate court, pursuant to Supreme Court Rule 23 (73 Ill.2d R. 23), vacated the circuit court's sentence and remanded the cause for a new sentencing hearing. (81 Ill. App.3d 1199.) We allowed the State's petition for leave to appeal. 73 Ill.2d R. 315.
