THE COURT. On February 18, 1938, the grand jury of Los Angeles County indicted the defendants Kynette, Allen and one Browne, charging them jointly in four counts with conspiracy to commit murder, attempted murder, assault with intent to murder and malicious use of explosives. A demurrer was interposed to the indictment. Upon motion of the prosecution the trial court made certain minor amendments therein and disallowed the demurrer. At the arraignment defendants entered pleas of not guilty to each of the four charges and proceeded to trial before a jury. At the conclusion of a protracted joint trial, the jury returned verdicts finding Kynette guilty of attempted murder, assault with intent to murder, and malicious use of explosives. Allen was found guilty on the charge of malicious use of explosives. Browne was acquitted on all charges. Motions for new trial and in arrest of judgment were made and denied. Judgment was thereupon entered against Allen, sentencing him to the state prison on count four for the term prescribed by law. Following the overruling of objections to the pronouncement of judgment against him on counts three and four, judgments and sentences were entered against Kynette for attempted murder and assault
